As science and religion researchers begin to engage questions of mental health, mindfulness may prove to be a fruitful area of investigation. However, quantifying the physical effects of mindfulness on the brain is difficult because mindfulness deals with the problem of mental and physical interaction or, the mind/body problem. One system of understanding which may aid science and religion scholars in the pursuit of mindfulness is traditional Chinese medicine (TCM). Within TCM, heart Qi manages the body's present connection to time (...) and space. If the “being in the moment” is disrupted, then the heart Qi is blocked and mental illness or various neurological disorders occur. Succinctly, within TCM, mindfulness is understood as a nonphysical phenomenon (Qi) which directly affects physical systems, resulting in empirical data. This is tracked and treated through the TCM understanding of Qi. The TCM view of Qi in mental health may therefore provide a helpful new paradigm to investigations concerning mindfulness and the human brain. (shrink)

The question 'Why should I obey the law?' introduces a contemporary puzzle that is as old as philosophy itself. The puzzle is especially troublesome if we think of cases in which breaking the law is not otherwise wrongful, and in which the chances of getting caught are negligible. Philosophers from Socrates to H.L.A. Hart have struggled to give reasoned support to the idea that we do have a general moral duty to obey the law but, more recently, the greater number (...) of learned voices has expressed doubt that there is any such duty, at least as traditionally conceived. This paper defends David Hume's "Of Miracles" from John Earman's (2000) Bayesian attack by showing that Earman misrepresents Hume's argument against believing in miracles and misunderstands Hume's epistemology of probable belief. It argues, moreover, that Hume's account of evidence is fundamentally non-mathematical and thus cannot be properly represented in a Bayesian framework. Hume's account of probability is show to be consistent with a long and laudable tradition of evidential reasoning going back to ancient Roman law.

Isaac Newton's Scientific Method examines Newton's argument for universal gravity and his application of it to resolve the problem of deciding between geocentric and heliocentric world systems by measuring masses of the sun and planets. William L. Harper suggests that Newton's inferences from phenomena realize an ideal of empirical success that is richer than prediction. Any theory that can achieve this rich sort of empirical success must not only be able to predict the phenomena it purports to explain, but (...) also have those phenomena accurately measure the parameters which explain them. Harper explores the ways in which Newton's method aims to turn theoretical questions into ones which can be answered empirically by measurement from phenomena, and to establish that propositions inferred from phenomena are provisionally accepted as guides to further research. This methodology, guided by its rich ideal of empirical success, supports a conception of scientific progress that does not require construing it as progress toward Laplace's ideal limit of a final theory of everything, and is not threatened by the classic argument against convergent realism. Newton's method endorses the radical theoretical transformation from his theory to Einstein's. Harper argues that it is strikingly realized in the development and application of testing frameworks for relativistic theories of gravity, and very much at work in cosmology today. (shrink)

The dark matter problem in astrophysics exposes an underappreciated weakness in the evidential warrant for General Relativity (GR). The "dark matter double bind" entails that GR gets no differential evidential support from dynamical phenomena occurring at scales larger than our solar system, as compared to members of a significant class of rival gravitation theories. These rivals are each empirically indistinguishable from GR for phenomena taking place at solar system scales, but make predictions that may differ radically from GR's at larger (...) scales. Thus the typical confidence in the universal applicability of GR is insufficiently warranted in the present evidential context. (shrink)

According to a rights forfeiture theory of punishment, liability to punishment hinges upon the notion that criminals forfeit their rights against hard treatment. In this paper, I assume the success of rights forfeiture theory in establishing the permissibility of punishment but aim to develop the view by considering how forfeited rights might be reclaimed. Built into the very notion of proportionate punishment is the idea that forfeited rights can be recovered. The interesting question is whether punishment is the sole means (...) for reclaiming forfeited rights. I argue for a pluralistic theory of rights reclamation, according to which, there are multiple ways by which a wrongdoer can recapture her forfeited rights. In particular, I argue that offering remorseful compensation is a valid means by which a wrongdoer might partially, or fully, reclaim her right against punishment. (shrink)

The conceptual framework of religion is more like the frame of a picture than the frame of a house; and what goes on within the frame is other than conceptual. This is the hypothesis motivating the analysis which follows. Given the hypothesis, the problem is to conceive what religion is - this other-than-conceptual enterprise which tends to attract conceptual frames. A possible answer is available in Wittgensteinian ‘seeing-as’. A number of philosophers of religion have recently exercised this option. Peter Kosso discusses the weak gravitational lensing observations of the Bullet Cluster and argues that dark matter can be detected in this system solely through the equivalence principle without the need to specify a full theory of gravity. This paper argues that Kosso gets some of the details wrong in his analysis of the implications of the Bullet Cluster observations for the Dark Matter Double Bind and the possibility of constructing robust tests of theories of gravity at galactic and greater (...) scales. Even the Bullet Cluster evidence is not sufficiently detailed to allow precision tests of General Relativity that would distinguish it from its rivals at galactic and greater scales. Taking into account the total evidence available, we cannot rule out “ugly” solutions to the dynamical discrepancy in astrophysics that involve both a large quantity of dark matter and a theory of gravity whose predictions differ significantly from those of General Relativity for interactions taking place at galactic and greater scales. McAdoo's recipe emphasizes an exit strategy that allows policymakers to throttle a crisis while minimizing collateral damage. When Washington Shut Down Wall Street recreates the drama of America's battle for financial credibility. McAdoo's accomplishments place him alongside Paul Volcker and Alan Greenspan as great American financial leaders. This paper compares four techniques for measuring the masses of galaxies and larger astrophysical systems from their dynamics. The apparent agreement of these techniques is sometimes invoked as reason for hypothesizing the existence of huge quantities of “dark matter” as the best solution to “the dynamical discrepancy”, the 100-fold disparity between the amount of mass visible in large scale astrophysical systems and the amount calculated from dynamics. This paper argues that the agreement, though suggestive, is not definitive. The coincident measurements (...) remain the best reason for preferring dark matter over revisions to General Relativity for solving the dynamical discrepancy, but the resulting warrant for this preference is weak. The book falls into four segments. In the first (Chapter 1), the particular conception of deity that has been predominant in western civilization—the theistic idea of God—is explicated and distinguished from several other notions of the divine. The second segment considers the major reasons that have been advanced in support of the belief that the theistic God exists. In chapters 2 through 4 the three major arguments for the existence of God are discussed, arguments which appeal to facts supposedly available (...) to any rational person, whether religious or not. Chapter 5 considers religious and mystical experience as a source and justification for theistic belief. And in Chapter 6 we examine the role that faith may play in the formation and justification of religious belief. We also consider the important issue of whether belief in God may be entirely rational quite apart from any evidence in its behalf. The third segment undertakes an examination of the problem of evil, which some have thought to provide rational grounds for atheism, the belief that the theistic God does not exist. A number of topics quite central to theistic religion are considered in the fourth segment of the book, chapters 8 through 11. These topics include miracles, the question of life after death, problems in relating the idea of divine foreknowledge to the belief in human freedom, and problems arising from the existence of diverse religions. The United States carceral system, as currently designed and implemented, is widely considered to be an immoral and inhumane system of criminal punishment. There are a number of pressing issues related to this topic, but in this essay, I will focus upon the problem of prison violence. Inadequate supervision has resulted in unsafe prison conditions where inmates are regularly threatened with rape, assault, and other forms of physical violence. Such callous disregard and exposure to unreasonable risk constitutes a severe violation (...) of the rights of prisoners by the state. While there have been numerous legal, political, and activist efforts to draw attention to this issue—with the goal of reforming and making prisons safer—my goal is different. I argue that inmates who are victims of prison violence should have their sentences automatically reduced. Two distinct arguments are advanced in support of this claim. First, I argue that acts of prison violence are a sort of state-mediated harm which can thus be appropriately described as punishment-constituting. Second, and more straightforwardly, I argue that the compensation owed to prisoners who are victims of prison violence may naturally take the form of a reduced sentence. (shrink)

This paper uses Popper's treatment of probability and an epistemic constraint on probability assignments to conditionals to extend the Bayesian representation of rational belief so that revision of previously accepted evidence is allowed for. Results of this extension include an epistemic semantics for Lewis' theory of counterfactual conditionals and a representation for one kind of conceptual change.

Hume says we never have grounds to believe in miracles. He’s right, but many commentators misunderstand his theory of probability and therefore his argument. This book shows that Humean probability descends from Roman law, and once properly contextualized historically and philosophically, Hume’s argument survives the criticisms leveled against it.
